S-Equol Regulatory Status: FDA NDI, GRAS & EU Novel Food

S-Equol Regulatory Status in the US & EU: FDA NDI, GRAS, Novel Food and Supplier Compliance

S-Equol Regulatory Status: FDA NDI, GRAS and EU Novel Food Requirements

For high-purity S-Equol ingredients, analytical quality, published human research and regulatory authorization are three distinct questions. This guide explains the US and EU frameworks, the evidence manufacturers should provide and why an approval or regulatory conclusion for one material cannot automatically be transferred to another grade.

2026 regulatory status note: FDA finalized guidance on NDI identity and safety information in October 2026. The EU has publicly listed a specific fermented soy germ powder application. Neither fact, by itself, establishes regulatory authorization for AIHerba’s purified S-Equol grade.

1. Is S-Equol Approved in the United States or European Union?

There is no single global approval that applies to every S-Equol ingredient, manufacturing process, product category or intended use. Regulatory status must be assessed using the actual material identity, method of manufacture, proposed exposure, destination market and applicable legal requirements.

A CAS number, clinical study, certificate of analysis or chemical substance database entry does not establish a food or dietary supplement authorization. For the documented high-purity product grade, review the AIHerba S-Equol ≥99% HPLC product specification . Its market eligibility must be determined separately.

2. US Dietary Supplements: The NDI Question Comes First

Under the Federal Food, Drug, and Cosmetic Act, companies must first determine whether a proposed material qualifies as a dietary ingredient. If it is a new dietary ingredient (NDI), premarket notification requirements may apply, subject to the statutory conditions and exceptions.

A fermented soy preparation, purified S-Equol, racemic equol and soybean isoflavone extract should not be treated as interchangeable regulatory identities. Review our Equol, S-Equol and R-Equol chemical identity guide and S-Equol fermentation and purification guide .

3. FDA October 2026 NDI Guidance: What Changed?

On October 19, 2026, the FDA announced final guidance titled “New Dietary Ingredient (NDI) Notifications and Related Issues; Identity and Safety Information About the NDI.”

The guidance focuses on how manufacturers and distributors should describe ingredient identity, history of use or other safety evidence, and the basis for concluding that a product is reasonably expected to be safe under its intended conditions.

Important: The guidance is not an approval of S-Equol. It provides FDA’s current recommendations for applicable notification submissions.

4. What Does the 75-Day NDI Notification Requirement Mean?

Where the NDI notification requirement applies, the relevant manufacturer or distributor generally must submit information to FDA at least 75 days before introducing the ingredient or a dietary supplement containing it into interstate commerce.

The submission contains the identity and safety basis for the proposed conditions of use. Submitting the notification should not be described as obtaining a universal FDA approval. The specific submission, agency correspondence, material identity and proposed use must be reviewed.

5. NDI vs GRAS: What Is the Regulatory Difference?

NDI and GRAS serve different regulatory purposes. NDI requirements concern qualifying new dietary ingredients in dietary supplements. GRAS concerns the general recognition of safety of a specified substance under its intended conditions of use in food.

Item NDI GRAS
Context Dietary supplements Specified food uses
Primary question Is notification required, and is safety supported? Is safe use generally recognized by qualified experts?
Scope Ingredient and conditions of use Substance and intended food use
Not equivalent to General FDA product approval Permission for every dietary supplement

For formulation decisions, see our Equol supplements and ingredient selection guide .

6. FDA GRAS Developments in 2026: Proposal vs Final Rule

On August 10, 2026, FDA announced a proposed rule addressing enhanced oversight of substances claimed to be generally recognized as safe.

The proposal must not be described as a fully implemented regulation. Companies should track its subsequent status through official sources. An upstream manufacturer’s statement that a GRAS project is underway likewise cannot be treated as a completed GRAS conclusion.

7. EU Novel Food Rules and the 15 May 1997 Threshold

Regulation (EU) 2015/2283 provides the European Union framework for novel foods. The assessment includes whether a substance had significant human food consumption within the EU before 15 May 1997 and whether it falls within a relevant novel-food category.

New manufacturing technologies, composition, source organisms, purification levels and historical consumption evidence may affect the evaluation. A novel food generally requires authorization before placement on the EU food market, subject to applicable law.

8. SE5-OH® Fermented Soy Germ Powder: What Does the EU Application Show?

The European Commission’s application summaries include a 2020 novel-food application for fermented soy germ powder. A dossier summary describes an S-Equol-containing fermented soy germ material known as SE5-OH®.

Critical distinction: An application is not automatically an authorization. Fermented soy germ powder is also not necessarily equivalent to a ≥99% purified S-Equol ingredient.

Buyers must verify whether an actual Union-list authorization exists and whether its specification and conditions cover the exact material intended for the finished product.

9. EU Union List vs Novel Food Catalogue vs EFSA Assessment

Three separate sources play different roles in EU market qualification.

Union List: The legal reference for authorized novel foods, their specifications and conditions of use.

Novel Food Catalogue: A non-binding and non-exhaustive orientation tool; it does not itself authorize marketing.

EFSA scientific opinion: Scientific evaluation that must be distinguished from the applicable Commission authorization.

If status is uncertain, consult the competent authority in the EU Member State where the food is intended to be first placed on the market.

10. Why S/R Identity and Manufacturing Route Matter

Regulatory comparability cannot be established from the words “S-Equol” or “99% HPLC” alone. A safety assessment must consider actual composition, production process and intended exposure.

The AIHerba reference COA for batch YGIF26072101 reports 100.0% HPLC purity and 99.82% dry-basis assay. Those results do not independently prove the S/R enantiomeric ratio or the product’s market authorization.

Review the S-Equol chiral HPLC and COA verification guide for analytical qualification methods.

11. What Documents Should a Supplier Provide?

An international buyer should request a product-specific technical package before relying on broad compliance claims.

  • Exact chemical identity and S/R specification.
  • Updated TDS and lot-specific signed COA.
  • Current HPLC and appropriate chiral analytical records.
  • Manufacturing process and facility identification.
  • Feedstock and processing-aid disclosures.
  • Residual solvents, heavy metals and microbiology.
  • Stability, storage and shelf-life evidence.
  • Allergen and GMO declarations, where relevant.
  • Actual NDI, GRAS or EU regulatory documents if claimed.
  • Use-specific legal and safety assessment.

12. Why Clinical Research Does Not Establish Regulatory Approval

Human studies have investigated S-Equol in menopause-related research and other settings. They may contribute to a scientific evidence package, but publication does not mean the studied ingredient or another supplier’s product has received market authorization.

A dose used in a study is not automatically a legally permitted daily amount. Health claims, disease claims and safety assessments must be evaluated in the relevant jurisdiction. See the S-Equol clinical evidence, research doses and safety review .

13. Food, Supplement, Cosmetic or Pharmaceutical Use?

Regulatory requirements vary according to intended product category. Rules applicable to dietary supplements and foods cannot simply be copied to cosmetics or medicines.

A manufacturer’s technical documentation should distinguish each intended use. Likewise, the biological formation of S-Equol by human gut microorganisms is a research mechanism, not a regulatory authorization. See the Equol-producer phenotype and gut microbiome guide .

14. United States vs European Union: Regulatory Decision Matrix

Requirement United States European Union
Regulatory question Dietary ingredient / NDI / GRAS Novel-food status / authorization
Identity Exact substance and process Exact food identity and specifications
Safety evaluation Intended-use safety basis Applicable novel-food safety assessment
Insufficient evidence CAS listing or generic research Application summary alone
Next step Qualified US regulatory assessment Verify Union List and competent authority position

Supplier availability does not, by itself, establish permission to market a finished consumer product.
